Our Employment Team are highly experienced in advising both employers and employees in relation to Whistleblowing and Protected Disclosure related matters.
What is Whistleblowing?
Whistleblowing is more formally known as making a 'Protected Disclosure’. The law protects an employee if they raise concerns about possible wrongdoing in a workplace they currently or previously worked in. An employee is also protected if they are dismissed or penalised for reporting possible wrongdoing.
Protected Disclosures Act 2014
The Protected Disclosures Act 2014 which came into force in July 2014 put employers on notice that employees would be afforded legal protection if they disclosed concerns regarding their employer, for example i relation to perceived health and safety breaches.
The risk for employers was (and is) that in some contexts, employees who have reason to believe their disclosure has led to their dismissal could then bring an action for unfair dismissal, bringing with it financial and reputational impact for the employer.
Protected Disclosures (Amendment) Act 2022
The Protected Disclosures Act 2014 as amended by the Protected Disclosures (Amendment) Act 2022, further protects workers in the public, private and not-for-profit sectors from retaliation if they speak up about wrongdoing in the workplace.
