The Plaintiff in this matter was a patient of a dentist in Dublin.
She was fitted with orthodontic braces and wore them for approximately 18 months, whereupon they were removed and she was given a set of retainers. By the evening of the date the braces were removed, there had been significant moving of her teeth such that her new retainers could not be fitted. The Plaintiff returned to the dentist two days later and he fitted her with new braces which caused further damage.
The Plaintiff instructed Lavelle Partners to investigate the circumstances of her injury and we obtained expert evidence from the UK from a consultant orthodontist. The expert noted that the Defendant was a General Dental Practitioner who claimed to be an expert in orthodontics, but in fact did not have or register with the General Dental Council of Ireland higher qualifications in orthodontics.
The expert concluded that the dentist made an incorrect diagnosis, persistent incorrect choices regarding her treatment, and that he caused significant root resorption to the Plaintiff’s teeth as a result.
Proceedings were issued on behalf of the Plaintiff and the case was successfully settled in advance of the trial date.
