The Plaintiff in this matter had a history of brain tumours and seizures before she developed a ganglioglioma of the right parietal lobe of the brain.
Three years later, she underwent a resection of the ganglioglioma at a Dublin hospital, but her condition gradually deteriorated until she was no longer independently mobile and suffered severe speech impairment as well as significant cognitive impairments.
Some five months following this surgery, it was discovered that she had an abscess on her brain and she underwent debridement of same. Owing to the failure of the hospital to identify the cerebral abscess following the surgery, the abscess was allowed to cause substantial brain reaction, leading to brain injury.
The Plaintiff’s family contacted Lavelle Partners and proceedings were issued in the name of the Plaintiff’s next of kin on behalf of the Plaintiff. Expert evidence was obtained confirming that a reasonable body of surgeons would have operated on the abscess at an earlier stage.
In advance of the trial date, the case was successfully settled.
