Avril Scally, Partner and Head of Clinical Negligence, addressed practitioners and professionals taking part in the Advanced Diploma in Medical Law course at the Honourable Society of King’s Inns on Saturday.
As part of an open panel discussion on clinical negligence issues from both plaintiff and defendant perspectives, Avril discussed the practical pitfalls that can arise in clinical negligence from the perspective of a plaintiff practitioner.
She specifically covered what to avoid when bringing a claim for clinical negligence on behalf of a plaintiff, including the importance of taking comprehensive initial instructions, obtaining all relevant medical notes and records, determining the limitation period with regard to the Statute of Limitations, and instructing the correct expert to prepare an opinion on liability and causation, as well as an overview of general challenges that can arise in the context of clinical litigation from a plaintiff’s perspective.
